The fate of tens of thousands of slot-like “skill games” across Pennsylvania is now in the hands of the state Supreme Court after justices heard final oral arguments this week.
The long-running dispute pits the state’s licensed casino industry and the Pennsylvania Lottery against the distributors and small business owners who host the machines in bars, convenience stores, and social clubs. The core legal question is whether these devices, which include a memory or pattern-recognition challenge, qualify as illegal gambling under state law or are legal because their outcome involves an element of player skill, not just chance.
State attorneys argued that the skill element is often optional or obscured, making chance the dominant factor—thus classifying them as illegal, unregulated slot machines. Conversely, attorneys for the manufacturers and distributors claimed the games offer a pathway for players to win back losses on every play, which fundamentally differentiates them from traditional slots.
The decision, expected early next year, will have profound consequences for the state’s lucrative gaming market.
