PA Supreme Court Decision Looming as 2026 Gaming “Gray Market” Reaches Boiling Point

The dawn of 2026 finds Pennsylvania at a historic crossroads. Following oral arguments in late November 2025, the Pennsylvania Supreme Court is expected to issue a final ruling any day now that will either legitimize or dismantle the state’s massive “skill game” industry.

With approximately 70,000 machines operating in gas stations and bars, the state’s highest court must decide if these devices are “slot machines” (illegal without a casino license) or “games of skill” (protected under current law).

The “New Year” Regulatory Updates

  • The Bipartisan $500 Fee: Senators Gene Yaw (R) and Anthony Williams (D) have pivoted to Senate Bill 1079, which sidesteps the messy tax debate by proposing a flat $500 monthly fee per machine. This would bypass the Governor’s 52% tax proposal while still generating an estimated $300 million for infrastructure.

  • Philadelphia Crackdown: The bill specifically targets Philadelphia’s “stop-and-go” convenience stores. It would require a valid ID to play and limits machines to a secondary revenue source, aiming to shut down unlicensed mini-casinos in residential neighborhoods.

  • Lottery Decline: The PA Lottery reported a $130 million profit drop in its most recent fiscal report, explicitly blaming untaxed skill games for siphoning away players.


New Year, New Taxes: The 90% Loss Deduction Cap

As of January 1, 2026, a major shift in federal tax policy has officially taken effect, creating a “phantom income” drama for lottery and casino winners across New York and Pennsylvania.

The Change: Under the new tax rules, gamblers can now only deduct 90% of their losses against their winnings. Previously, you could deduct 100%.

The Fallout: If an East Coast winner hits a $100,000 jackpot but spent $100,000 on tickets over the year, they are now taxed on $10,000 of “profit” that doesn’t actually exist. This has sparked a “repeal the tax” movement led by Nevada and New Jersey lawmakers this week.


New York Drama: The Anonymous Winner Bill

While PA fights over machines, New York is addressing “winner drama” with Senate Bill S2613.

  • The Bill: Currently active for the 2025-2026 session, it seeks to shield the identities of winners for prizes over $5,000.

  • The Justification: Legislators cited a rise in “violent crime and fraud” against recent multi-million dollar winners in the tri-state area. The bill would bring New York in line with Delaware and Maryland, allowing winners to stay anonymous by default.
